What is a California Pay Data Report?

The obligation for California Pay Data Reporting is relatively recent, with the first yearly report due in May 2023. Certain employers are mandated to share workforce information with the California Civil Rights Department (CRD) every year. This reporting obligation is enforced under the Government Code section 12999, updated by Senate Bill 1162 on September 28th, 2022. Senate Bill 1162 dictates that employers must provide yearly wage and demographic information to the state.

What are the Types of California Pay Data Reports?

There are two different types of California Pay Data Reports. Certain employers might only need to fulfill one type of these reports, whereas others might need to address both. The criteria to identify whether an employer needs to submit a report are as follows:

Payroll Employee Pay Data Report

Payroll Employee Pay Data Report requirements:

  • Private employers with 100+ employees in the previous year
    • AND
  • Either are based in CA or employ at least one employee in CA

Labor Contractor Employee Pay Data Report

Labor Contractor Employee Pay Data Report requirements:

  • Private employers with 100+ Labor Contractor Employees hired through Labor Contractors
    • AND
  • Either are based in CA or employ at least one Labor Contractor Employee in CA

NOTE: Remote workers should be included in the total employee counts. Employees from all affiliated companies should be included in the total Payroll Employee count. Workers from all Labor Contractors should be included in the total Labor Contractor Employee count.

When is California Pay Data Reporting due?
